This privacy policy ("Privacy Policy") describes how Kindred Album LLC ("Kindred Album", "we", "us", or "our") collects, uses, and shares personal information in connection with our website located at kindredalbum.com, and any other websites, applications, or online services that we own and operate and that link to this Privacy Policy (collectively, the "Service"), and our email communications, social media pages, and related products and services (collectively, and together with the Service, the "Platform"), and the rights and choices available to individuals with respect to their personal information.
Kindred Album is a private, invite-only photo and video sharing service designed to help adults share family albums with the people they choose. Your private albums are for your invited circle, not an ad-supported social feed. We do not permit third-party advertising networks to use private album content for their own targeted advertising purposes.
We reserve the right to modify this Privacy Policy at any time. If we modify how we collect, use, or disclose personal information, we will post the updated Privacy Policy on this page. In some cases, we may notify you about an update by sending you an email, posting a notice on the Platform, or other means as may be required by applicable law. Please review this Privacy Policy periodically to keep up to date on our most current policies and practices.
COLLECTION OF PERSONAL INFORMATION
Depending on how you engage with the Platform, we may collect the following categories of personal information about you. We may also collect other personal information that is not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed to you.
Contact information, such as your first and last name, email address, phone number, and social media handle.
Account information, such as login credentials, profile picture, album role/authorization, account settings, invitation and notification status, albums you create or join, and information about how you use account features.
Demographic information, such as gender and age.
Album content, such as photos, videos, captions, comments, emoji reactions, and other content you upload, submit, or make available through an album.
Survey responses, such as the information you provide in response to our surveys, sweepstakes, contests, promotions, or questionnaires.
Communications, such as information you provide when you contact us with questions, feedback, support requests, or otherwise correspond with us.
Marketing preferences, such as your preferences for receiving communications from us and details about how you engage with our communications.
Payment information, if and when we offer paid subscriptions, such as subscription tier, payment amounts, billing contact information, and payment method details. Payment processing services may be provided by a third-party payment processor.
Online activity information, such as linking pages, pages or screens you viewed, your time spent on a page or screen, your navigation paths between pages or screens, information about your activity on a page or screen, your access times, duration of access, and other online activity information collected automatically.
Device information, such as your computer and mobile operating system, operating system type and version number, wireless carrier, manufacturer and model, browser type, screen resolution, general location information such as city, state, or geographic area, and depending on your device settings, and other device information collected automatically. Only limited metadata (e.g., capture timestamp) is retained and stored as it concerns photographs and videos published to albums.
We may collect the categories of personal information described above from the following sources:
Personal information you provide us, including when you create an account, create or join an album, upload content, sign up for marketing communications, or contact us.
Personal information from other users, such as when an album owner or co-host invites you to join an album or gives you access to album content. Please do not submit another person’s contact information unless you have permission to do so.
Personal information from third parties, such as our service providers, integration partners, advertising partners, operating systems and platforms, social media platforms, data providers/licensors, and public sources, and, in the future, payment processing providers. We may merge or combine such personal information obtained from third parties with the personal information we collect from you directly or automatically.
Personal information collected automatically, such as device information and online activity information, which may be logged by us, our service providers, and our advertising partners over time on our Platform and other sites and online services. We do not use user-submitted album content for third-party targeted advertising. To facilitate this automatic collection, we may use the following technologies:
Cookies, which are text files that websites store on a visitor’s device to uniquely identify the visitor’s browser or to store information or settings in the browser for the purpose of helping you navigate between pages efficiently, remembering your preferences, enabling functionality, helping us understand user activity and patterns, and facilitating online advertising.
Web beacons, also known as pixel tags or clear GIFs, which are typically used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked, typically to compile statistics about usage of websites and the success of marketing campaigns.
Local storage, which is used to save data on a visitor’s device. We may use data from local storage to, for example, turn on web navigation, store multimedia preferences, customize what we show you based on your past interactions with our Platform, and remember your preferences.
Session-replay technologies, which are third-party software programs that we may use on the Platform to record a video replay of user’s interactions with the Service. The video replay may include users’ clicks, mouse movements, scrolls, typing, and other activity taken during the session, but will not include album images/photographs. We may use these replays for research and development purposes, such as to help us troubleshoot problems with the Service, understand how users interact with and use the Service, and identify areas for improvement.
Chat technologies, to operate any chat features that you may use to communicate with us or that may otherwise be provided through the Service. Our chat vendors and other third parties may access and use user content, and the device and online activity information described above, and monitor and record your chats, for the purposes described in this Privacy Policy. In most cases, when you use these features, you are communicating with a digital agent and not a human.
USE OF PERSONAL INFORMATION
Our primary purpose in collecting personal information is to provide the Platform and the services you request. We also use personal information for the purposes set forth below and as otherwise described in this Privacy Policy or at the time of collection.
Provide the Platform. We use personal information to provide our Platform and operate our business. For example, we may use personal information to:
provide, operate, and improve the Platform;
process and fulfill your transactions, including any future subscription offerings;
establish, manage, monitor, and maintain your account;
process and manage invitations, album membership, account roles, and album permission settings;
host, store, display, and make available album content to the people authorized to access the applicable album;
provide support, respond to inquiries, troubleshoot issues, and communicate with you about the Platform;
send service-related communications, such as account, security, invitation, album activity, and administrative messages; and
fulfill any other purpose for which you provide personal information.
Artificial Intelligence Tools. When operating our business, we may use services or applications that are supported by artificial intelligence (AI) or machine learning technologies. For example, we may use such technology to support our marketing or advertising efforts, to develop or improve the Platform, features, or functionality, or to improve how we address your support requests or inquiries. In addition, our third-party service providers may also use AI technologies in connection with the services they provide to us. Depending on how you interact with us or if you engage with an AI-powered feature, your personal information may be processed to provide relevant outputs or to improve the models we use. Unless you receive a supplemental privacy notice relating to such services, personal information, including album content, will not be used to train AI models and your personal information will continue to be treated in the same ways that are described in this Privacy Policy.
Direct Marketing. We may use your personal information to send you Kindred Album-related or other marketing communications as permitted by law. You may opt-out of our marketing and promotional communications as described in the section titled "Your Choices" below.
Targeted Advertising. We may contract with third-party advertising companies and social media companies to help us advertise our business and Platform, identify potential customers, and display ads on our Platform and other sites and services. These companies may use cookies and similar technologies to collect information about you (including the device information and online activity information described above) over time across our Platform and other sites and services or your interaction with our emails, and use that information to serve ads that they think will interest you. You can learn more about your choices for limiting targeted advertising under the section titled "Your Choices" below. These activities are separate from the private album experience, and we do not permit third-party advertising networks to use private album content for their own targeted advertising purposes.
Research and Development. We may use your personal information for research and development purposes, including to analyze and improve the features and functionality of our Platform, understand and analyze the usage trends and preferences of our users, and develop and improve our Platform, features, and business. As part of these activities, we may create aggregated, de-identified or other anonymous data records from your personal information and other individuals whose personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We may use this anonymous data and share it with third parties for our lawful business purposes.
Compliance, Fraud Prevention, and Safety. We may use your personal information to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities; protect our, your, or others’ rights, privacy, safety or property (including by making and defending legal claims); maintain the integrity, security, and reliability of the Platform; audit our internal processes for compliance with legal and contractual requirements and internal policies; enforce the terms and conditions that govern the Platform; and prevent, identify, investigate and deter fraudulent, harmful, unauthorized, unethical or illegal activity, and cyberattacks and identity theft.
With your consent. We will use and disclose your personal information in accordance with your prior direction or, in some cases, we may specifically ask you for your consent to collect, use, or share your personal information, such as when required by law.
DISCLOSURE OF PERSONAL INFORMATION
In addition to the specific situations discussed elsewhere in this Privacy Policy or at the point of collection, we may disclose your personal information to the following entities or persons.
Other users you choose to share with. Album content and related activity may be visible to the album owner, co-hosts, contributors, readers/participants, and other individuals with authorized access to that album, depending on their role and permissions. For example, owners and co-hosts may be able to see member email addresses and manage membership. Contributors may post photos and videos but may have more limited access to member information. Readers/participants may view album content, comment, and react if authorized for the album. authorized album members may be able to save images through their browser, take screenshots, or otherwise copy content they can view. We cannot prevent all copying or downstream sharing by people you choose to invite to an album. Please only invite people you trust and only upload content you have the right to share.
Service providers. We may share personal information with service providers that help us operate our business or the Platform on our behalf, such as web hosting, data storage, email delivery, performance monitoring, analytics, research and development, security, customer support, and, if applicable, payment processing.
Advertising partners. We may share personal information with third parties who we partner with for advertising campaigns or that collect information about your activity on the Platform and other online services for the purposes described in the "Targeted Advertising" section above. These activities are separate from the private album experience. We do not permit third-party advertising networks to use private album content for their own targeted advertising purposes.
Sweepstakes and joint marketing partners. We may disclose your personal information to our partners in order to provide you with content and other features through the Platform, and such partners may send you promotional materials or otherwise contact you regarding products and services that they offer.
Professional advisors. We may disclose personal information to persons, companies, or professional firms providing Kindred Album with advice and consulting in accounting, legal, tax, financial, debt collection, insurance, and other matters, where necessary in the course of the professional services that they render to us.
Authorities and others. We may share personal information with law enforcement, government authorities, and private parties, as we believe in good faith to be necessary or appropriate to comply with law or for the compliance, fraud prevention, and safety purposes described above.
Related companies. We may share your personal information with companies that are affiliated with us (that is, that control, are controlled by, or are under common control with us) or may be affiliated with us in the future for the purposes described in this Privacy Policy.
Business transaction participants. We may sell, transfer, or otherwise disclose some or all of your personal information to third parties in connection with any business transaction (or potential transaction) involving a merger, acquisition, sale of shares or assets, financing, consolidation, reorganization, divestiture, or dissolution of all or a portion of our business (including in connection with a bankruptcy or similar proceedings).
YOUR CHOICES
Account information. You may access or update certain account information through your account settings or by contacting us.
Account deletion. You may request or initiate account deletion through the Platform or by contacting us. Please review our Terms of Use and any deletion notices carefully because deletion may be permanent and may delete content you contributed to shared albums.
Album settings and membership. Album owners and co-hosts may manage certain album membership and permission settings through the Platform.
Email marketing communications. You may opt out of marketing emails by following the unsubscribe instructions in the email or by contacting us as provided at the end of this Privacy Policy. Even if you opt out of marketing communications, we may still send you service-related, transactional, legal, or administrative messages.
Cookies. Most browsers let you remove and/or stop accepting cookies from the websites you visit. To do this, follow the instructions in your browser’s settings. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, however, you may not be able to use all functionality of the Platform and certain services may not work properly. Analytics. We may use Google Analytics and other analytics providers to help us analyze how our Platform is being accessed and used. To opt-out of Google Analytics, you can download and install the Google Analytics Opt-out Browser Add-on, available here.
Advertising Choices. You can limit the use of your information for targeted advertising by blocking third-party cookies in your browser settings, using browser plug-ins/extensions, and/or using your mobile device settings to limit the use of the advertising ID associated with your mobile device. You can also opt out of targeted ads from companies participating in the following industry opt-out programs by visiting the linked websites: the Network Advertising Initiative (https://thenai.org/how-to-opt-out/) and the Digital Advertising Alliance (https://optout.aboutads.info). Some of the companies we work with may offer their own opt-out mechanisms. Many of the opt-out preferences described in this section must be set on each device or browser for which you want them to apply. Please note that some of the advertising companies we work with may not participate in the opt-out mechanisms described above, so even after opting-out, you may still receive interest-based advertisements from other companies. SECURITY OF PERSONAL INFORMATION
No method of transmission over the internet, or method of electronic storage, is fully secure. While we use commercially reasonable efforts to protect your personal information from the risks presented by unauthorized access or acquisition, we cannot guarantee the security of your personal information.
CHILDREN’S PRIVACY
The Platform may be used by adults to share photos or videos that include children or other family members. We do not knowingly collect personal information directly from children or minors under 18. If you believe that a child or minor has provided us with personal information, please contact us, and we will take appropriate steps to delete such information in accordance with applicable law.
INTERNATIONAL TRANSFER OF PERSONAL INFORMATION
Kindred Album is headquartered in the United States, and we may have service providers in the United States and other countries. Please be aware that your personal information may be transferred to, stored, or processed in the United States and other locations for the purposes described in this Privacy Policy. Privacy laws in the locations where we handle your personal information may not be as protective as those in your jurisdiction. By providing your personal information, where applicable law permits, you specifically and expressly consent to such transfer and processing and the collection, use, and disclosure set forth in this Privacy Policy.
LINKS TO OTHER SITES AND SERVICES
The Platform may contain links to third-party websites, services, or resources. This Privacy Policy does not apply to third-party websites or services. We are not responsible for the privacy practices of third parties, and we encourage you to review their privacy policies before providing personal information to them.
ADDITIONAL NOTICE TO CALIFORNIA RESIDENTS (SHINE THE LIGHT)
California’s "Shine the Light" law (Civil Code Section § 1798.83) permits users of our Platform that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes, if any. To make such a request, please contact us as provided at the end of this Privacy Policy. You must include the words "Shine the Light" in your subject line or correspondence.
ADDITIONAL NOTICE TO NEVADA RESIDENTS
Nevada Revised Statutes Chapter 603A allows Nevada residents to opt-out of the "sale" of certain types of personal information. Subject to several exceptions, Nevada law defines "sale" to mean the exchange of certain types of personal information for monetary consideration to another person. If you are a Nevada resident who wishes to exercise your "sale" opt-out rights, you may submit a request to us using the contact information listed at the end of this Privacy Policy.
